Introduction:

These terms and conditions apply to the use of the Gastro Nicks website. By accessing our website and/or placing an order, you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you should not access our website.

Product Availability & Conditions of Sale:

We aim for minimum shelf life of 7 days from point of dispatch for most perishable goods, so please ensure that you schedule delivery with this timeframe in mind.

The weights given are approximate only and packaging may vary from that shown. In the event of supply difficulties, Gastro Nicks reserve the right to substitute goods or packaging of equal quality and value.

All items featured on our website are subject to availability.

Gifts and their contents are configured for safe and secure transit using the appropriate packaging methods, at Gastro Nicks’ discretion.

Imagery & Photography:

The product images shown on the website are intended for presentation purposes only.

All contents have been fairly described and photographic props such as demonstrative foods, plates, glasses, cutlery, and other utensils are not included unless stated.

Alcohol Policy:

Items containing alcohol can only be ordered by and delivered to persons aged 18 and over.

Products and Allergens:

All allergen labelling is supplied by our suppliers. Therefore, all responsibility for allergens and labelling sits with the food producer (third party supplier) themselves.

Generally, all ingredients are printed on the packaging of each item, with any allergens highlighted. This is provided to Gastro Nicks in retail condition, ready for sale direct to the customer.

Gastro Nicks comply with strict Environmental Health Guidelines in the storage of all food and drink products, as per producers’ instructions.

Delivery:

Whilst we will do our utmost to ensure deliveries are made as soon as possible or on the requested date, the responsibility for delivery rests with our third-party delivery companies and, occasionally, deliveries may be delayed.

Please notify in writing to Gastro Nicks any claim for non-delivery of any goods within 3 days of the intended delivery date.

Our guarantee is limited to delivering to the building, not individual recipients.

Gastro Nicks do not accept any responsibility for any loss, damage, delay or other disruption in supply and deliveries brought about by inaccurate or incomplete delivery address details being provided at the time of ordering.

Prices quoted are subject to change without notice.

Gift vouchers

Our gift vouchers can be used as full or part payment for Gastro Nicks products. Vouchers cannot be exchanged for cash.

Vouchers are personal to each individual and any inappropriate use is fraud.

Lost, stolen or destroyed gift vouchers cannot be exchanged or refunded.

Refunds:

Please note that we are unable to accept the return of food hampers or fresh produce due to the nature of the products they contain.  This does not affect your statutory rights.

If you wish to return an item or items paid for with a Gastro Nicks gift voucher, we will only be able to issue you with another gift voucher to the value of the item(s) returned.

Website availability and accuracy

Whilst we use reasonable endeavours to verify the accuracy of any information we place on the website, we make no warranties, express or implied, in relation to its accuracy. The website is provided on an “as is” and “as available” basis without any representation or endorsement made.

We do not guarantee that our website or services will be uninterrupted or error-free and will not be responsible for any losses arising from such errors or interruptions.

Additionally, we reserve the right at any time to suspend, restrict or terminate access to the Gastro Nicks website and/or our products or services for any reason (including, but not limited to, repair, maintenance and improvement).

 Limitation of Liability

Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, breach of contract or breach of statutory duty, nor will any of these terms restrict any of your statutory rights. For further information about your statutory rights, contact your local authority Trading Standards Department or Citizen’s Advice Bureau.

We will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations, if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, weather, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.

The maximum liability of Gastro Nicks arising out of any order for the supply of goods to you in contract, misrepresentation, restitution or otherwise, arising in connection with the performance of this contract, shall be limited to the price paid for the goods. Under no circumstances shall Gastro Nicks be liable for any form of indirect or consequential loss, costs or expenses as a result of this agreement or contract.

Data Protection

We respect your privacy. The personal information that you give us is held with care and security. We will not sell, rent or transfer this information to third parties for their marketing purposes unless you agree otherwise. Please see our full privacy policy.

Law & Jurisdiction

This agreement shall be governed by English law: The courts of England and Wales will have exclusive jurisdiction to adjudicate any dispute arising under or in connection with this agreement.
